Der primare Untersuchungsgegenstand dieser Arbeit ist das Folterverbot in seinen verschiedenen Ausformungen. Zunachst werden Regelungen bzw. Rechtsregimes im internationalen Recht analysiert, um einen differenzierten UEberblick uber Inhalt, Ausgestaltung und Durchsetzungsmechanismen einschlagiger voelkerrechtlicher (Anti-)Foltervorschriften zu geben. Besonderer Fokus liegt dabei auf dem Voelkerstrafrecht, und hier insbesondere auf den Vorschriften des Roemischen Statuts des Internationalen Strafgerichtshofs. Das herauskristallisierte Regelungsgeflecht wird sodann daraufhin untersucht, ob es in Extremsituationen Ausnahmen von den Verboten zulasst. Zur besseren Veranschaulichung wird dazu als Beispiel Deutschland herangezogen, an dem konkrete Auswirkungen des voelkerrechtlichen Folterregimes auf staatliches und individuelles Handeln untersucht werden. Dabei wird zwischen denkbaren Ausnahmen unterschieden, die fur den Staat selbst gelten koennten und solchen, die von dem handelnden Individuum geltend gemacht werden koennten. Letztere sind in Form von Straffreistellungsgrunden denkbar, die auf ihre Anwendbarkeit in Folterfallen uberpruft werden.
