Der Erfolg der europaischen Integrationsgemeinschaft ist zu einem ganz erheblichen Teil auch der Erfolg ihrer Gerichtsbarkeit. Der Gerichtshof der Europaischen Union hat mit fruhen wegweisenden Entscheidungen und mit einer von bemerkenswerter Konzeption, Koharenz und Kontinuitat gepragten Rechtsprechungspraxis entscheidend zur Entwicklung der europaischen Rechtsgemeinschaft beigetragen. Das Vorabentscheidungsverfahren wird als wichtigstes Verfahren innerhalb der europaischen Rechtsordnung beschrieben. Es stellt die Verbindung zu den nationalen Gerichten her und bildet eine Schnittstelle zwischen nationalem Recht und Unionsrecht, so dass gemeinsam Recht gesprochen wird. Nach anfanglichem Zoegern ergeht mittlerweile die uberwiegende Zahl der Entscheidungen des EuGH im Verfahren der Vorabentscheidung. Diese Arbeit betrachtet Kooperations- und Beschleunigungsmechanismen im Vorabentscheidungssystem. In welche Richtung entwickeln sich diese Mechanismen derzeit? Inwieweit koennen sie, auch zur gegenseitigen Erganzung, zur Weiterentwicklung des Vorabentscheidungsverfahrens zusammengefuhrt werden? Kann eine starkere Einbeziehung des nationalen Richters in das Verfahren vor dem EuGH erreicht werden, ohne dabei den erfolgreichen Charakter des Vorabentscheidungssystems grundlegend zu verandern?

Bei dem Werk "Die Geburt der Klinik" handelt es sich um eines der fr hen Werke von Michel Foucault. Es war seine dritte gro e Ver ffentlichung und erschien 1963, zwei Jahre nach der Ver ffentlichung des Buches "Gesellschaft und Wahnsinn." Das Buch sucht hinsichtlich seiner Eigent mlichkeit und inhaltlichen Dunkelheit an einigen Stellen wohl Seinesgleichen. "Die Geburt der Klinik" gilt gemeinhin als st rkste Ann herung Foucaults an die moderne Str mung des Strukturalismus, obgleich der Autor stets verneinte, Strukturalist zu sein. Dennoch darf dieses Werk - neben "Die Ordnung der Dinge"- als Foucaults am meisten von der um die Zeit der Ver ffentlichung herum in Frankreich in den Humanwissenschaften weithin grassierenden Welle beeinflussten Arbeiten gelten. Nie wieder sollte ein solch starker Einfluss in einer seiner Arbeiten sp rbar werden. Das Werk behandelt die Thematik der Ver nderungen im franz sischen Medizinwesen vor dem Hintergrund der franz sischen Revolution, mit besonderem Augenmerk auf die Rolle des Individuums im Fokus des " rztlichen Blicks" und den Ver nderungen des "Werkzeugs" Sprache im semantischen Feld der Medizin, dass als deutlichstes Merkmal eines Wandels im gesellschaftlichen Bewusstsein einer detaillierten Betrachtung unterworfen wird. Foucault wendet hier seine Methode der "Arch ologie" an, welche zumindest vordergr ndig an die Methodik des Strukturalismus erinnert, auch wenn, wie sich zeigen wird, nicht zu verkennende Unterschiede zwischen beiden Verfahrensweisen bestehen.
