Der Preis für Wohlstand und Funktionsfähigkeit der modernen Industriegesellschaft besteht in dem Eingehen von sozialen, technischen und ökologischen Risiken. Diese Risiken werden in der Bevölkerung unterschiedlich bewertet. Dabei unterscheidet sich häufig das subjektive Risikoempfinden von der objektiven Risikobewertung. Die hierzwischen entstehende Lücke klafft weit auseinander und erschwert eine rationale Diskussion über die Bewertung von Risiken. Um sie zu schließen, bedarf es einer vertiefenden Auseinandersetzung über die Methodik der Risikobewertung, zu der hier aus ethischer wie juristischer Sicht ein Beitrag geleistet werden soll. English summary: Lex Posterior Principle and Constitutional Law The lex posterior principle resolves conflicts in law by reference to the criterion of time: the later law prevails. Reducing this principle to a tool of legal interpretation does not do justice to its constitutional dimension. This work situates the derogation rule within the order of the German Basic Law and locates its roots in the legal order's openness to change - a possibility that is warranted by the democracy principle and allows to navigate tensions between continuity and flexibility in the exercise of state authority. German description: Spateres Recht geht vor, bestimmt der Posterioritatsgrundsatz (lex posterior derogat legi priori) zur Losung von Normenkollisionen nach dem Kriterium der Zeit. Dieser Derogationsgrundsatz, dessen Wurzeln bereits im romischen Recht zu finden sind, pragte und pragt nicht nur die deutsche Rechtsordnung uber Zeiten hinweg und offenbart sich in vielfaltigen Erscheinungsformen. Eine Beschrankung allein auf methodische Aspekte greift bei der Betrachtung des Posterioritatsgrundsatzes zu kurz und wird seiner nahezu universellen Dimension nicht gerecht. Die Arbeit fragt - den Posterioritatsgrundsatz als ungeschriebenes Verfassungsrecht ausweisend -, auch nach seiner grundgesetzlichen Verortung.
