Die Finanz- und Wirtschaftskrise, die im Jahr 2007 mit dem Zusammenbruch des US-Immobilienmarktes ihren Anfang nahm, verursachte nicht nur Panik auf den globalen Devisen- und Anlagem rkten und eine Vernichtung von privatem Geldverm gen in bis dato ungekanntem Ausma , sondern konfrontierte die europ ische ffentlichkeit mit einem Ph nomen, das eigentlich als undenkbar galt: Die Insolvenz von Nationalstaaten. W re die Einleitung eines Insolvenzverfahrens f r zahlungsunf hige Staaten wie Portugal in Anlehnung an das deutsche Regelinsolvenzverfahren, das bisher nur auf nat rliche und juristische Personen, jedoch nicht auf juristische Personen des ffentlichen Rechts angewandt werden kann, denkbar? Der Versuch der bertragung der deutschen Insolvenzordnung auf die Insolvenz von Staaten macht deutlich, warum es bis heute im Falle einer Insolvenz eines Nationalstaates zu keiner Konstitutionalisierung im internationalen Rechtsraum gekommen ist. Obwohl das Szenario staatlicher Zahlungsunf higkeit im Zuge der j ngsten Finanz- und Wirtschaftskrise auch f r westliche Industrienationen neuen Impetus erfahren hat, gibt es bis heute keine verbindlichen Regelungen, ja noch nicht einmal Ans tze, welche politischen und vor allem rechtlichen Folgen die Insolvenz eines Staates haben k nnte. Unter Ber cksichtigung einiger grunds tzlicher Prinzipien, die in erster Linie eine m gliche Einschr nkung der staatlichen Souver nit t des Schuldnerstaates und die Gew hrleistung der Erf llung seiner staatlichen Aufgaben tangieren, scheint eine bertragung der Verfahren und Grunds tze der deutschen Insolvenzordnung, insbesondere des Insolvenzplanverfahrens durchaus denkbar.
