Australia has a strong tradition of labour historiography, which until recently has been focused on the institutions of the labour movement: trade unions and labour parties. This book shifts the focus back to the workplace and looks at how and why the nature of work changed during the period from the late nineteenth century to World War II. The book focuses on three industries in the state of Victoria: clothing, bootmaking, and printing. Concerned with the complex relationship between economic and technological change, the nature of sexual division in the workforce, and the role of union, employer and state activists, it carefully traces the impact of all of these factors on wage levels for men and women. The treatment of these themes touches on wide historical issues, as we follow the fortunes of Victorian manufacturing, and consider the political strategies of the trade unions of the time and the state's response to them. The study is also an important piece of social history, evoking the nature of work for many Australians of the period.

From "I'm here to close you down" to conflicts of interest, members of parliament using parliamentary privilege as a way of attacking private providers without any evidence, those who come back for a second bite of the cherry and an alarming lack of empathy. This book also exposes some of the alarming contradictions and inconsistent decision-making of the national VET regulator. With contributions from Education Issues Australia and a range of 'survivors', it's time these stories were told in the public interest.There is absolutely no question that the public would be horrified if it understood the amount of damage being caused by an inefficient, incompetent regulator. Equally, they would be horrified if they knew that policy changes are nothing more than mere distractions to prevent the public from identifying the significant injustice being wreaked daily by a government body that is supposed to be beyond reproach.The public interest is not served when people are dying, killing themselves, experiencing nervous breakdowns so severe that they can no longer work for years after their ASQA experience, as a result of being part of this sector. It's also not served when industry and subject matter experts have been 'evicted' from the system that should be helping to lay the foundations for our future generations.In April 2020, the Administrative Appeals Tribunal ("AAT") made a significant finding that should change the way private RTOs are viewed during merits review and stay hearings. When the AAT makes a statement that 'We have concluded that in future cases where there is a contest about non-compliances, ASQA must start and do so without the assumption that its allegations of non-compliance are prima facie correct', it opens the door for truth, understanding and empathy for all that has been lost while the regulator got it wrong.

Legal Decision-Making Under the National Vocational Education and Training Regulator ACT 2011 (Cth): : An Investigation Into Access to Merits Review
This paper discusses the legal decision-making process as it applies to the National Vocational Education and Training Regulator Act 2011 (Cth) ("NVR Act") and how this impacts access to merits review while highlighting some significant areas of concern. These areas of concern are a cause for alarm at the highest levels of government and the judiciary. This paper does not seek to offer solutions. This paper was initially prepared in partial completion of a Supervised Legal Research project in the Faculty of Law at Murdoch University as part of a Bachelor of Laws (Graduate Entry) and merely seeks to highlight these areas of concern to enable focussed and critical discussions and investigations to commence. It is also hoped that this paper will be the basis for further research.Some of the key topics that will be discussed include consideration of issues of public interest and the concerns that are raised when the very basis for legal decisions under the NVR Act is potentially flawed and based on an unqualified foundation. The research considers the legal meaning and interpretation of the term 'decision' looking to statute and case law for guidance; a crucial factor for this research because if an administrative action (such as those referred to in this paper) does not constitute a 'decision' for the purposes of the Administrative Decisions (Judicial Review) Act 1997 (Cth), it cannot be reviewed. While reviewing Australian Broadcasting Tribunal v Bond, suggests that the steps in the process of making a final determination do not, in themselves form the final decision, it is precisely on the basis of these 'steps' that decisions are being made by the Australian Skills Quality Authority ("ASQA"). This paper highlights that the reasons given by ASQA in their legal decisions explicitly state that the 'decision' has been made due to non-compliance with the legislative requirements that these 'steps' are based upon. Another key area of focus in this paper is that of the Model Litigant Obligation in the Legal Services Directions 2017 (Cth) and how adherence to this 'Obligation' by ASQA lawyers as model litigants continues to be the cause for concern amongst legal practitioners.This paperback version has bonus content and offers that are not available in the ebook.
