Since the outset of his career, David Reed s central preoccupation has been to challenge and reinvent how to make a painting. Consistently, his paintings present a compelling tension between the gestural and the impersonal; in recent times this has been characterized by fluid, torquing, extended marks that reveal the viscosity of paint and the speed of colour and light in a flattened manner that looks photographic or filmic. David Reed documents the artist s 2020 exhibition of new work at Gagosian in New York, presenting 15 outsize paintings that, in many cases, were over a decade in the making. The plates are punctuated by striking details of several works. The artist s working drawings, which he has long made to document the many stages of a painting s creation, are illustrated throughout the plate section, offering insights into his varied sources and complex processes. Understanding Miscarriages of Justice explores a paradox. In a society in which justice is uncertain and contested, how can we talk meaningfully about miscarriage of justice? The book examines the structural conditions that inevitably produce high-profile miscarriages of justice. The thesis of the book is that there is a tension between the rhetoric of justice as understood outside of law, particularly in the media, and legal practice. Despite evidence that miscarriages of justice must be a normal and expected consequence of imperfect arrangements for investigations, prosecutions, and trials, they are ordinarily understood as exceptional and unacceptable events. Periodically, however, miscarriages are seen not as exceptional, but widespread and normal. At such moments, the legitimacy of the criminal justice process is called into question in the media. These moments are constructed in the media as a crisis of public confidence in criminal justice. With the mass media's vivid interest in crime and punishment and their relentless reconstruction of relevant facts, the courts fact-finding monopoly is fundamentally contested. While this happens in all phases of a criminal process, the contest becomes particularly dramatic when after a criminal conviction the mass media continue their investigation and discover, according to their criteria of truth, a miscarriage of justice. But there is no set of common criteria that would allow for the design of rational procedures to end the contest. There is no forum, no procedure, and no set of criteria that would make possible a common search for truth.

Niklas Luhmann's sociological theory treats law, along with politics, economics, media and ethics, as systems of communication. His theory not only offers profound and novel insights into the character of the legal system in modern society, but also provides an explanation for the role of jurisprudence as part of that legal system. Werden die dabei teils eklatant voneinander abweichenden Definitionen ber cksichtigt, muss attestiert werden, dass der Begriff u erst inflation r verwendet wird. Der Bundeszentrale f r politische Bildung zufolge erlebt die Formulierung "(...) in den vergangenen Jahren, insbesondere im deutschsprachigen Raum, eine Renaissance." Zu den Theoretikern, die sich um eine pr zise begriffliche Verortung der Formulierung bem hten, geh ren unter anderen Hannah Arendt, John Rawls, J rgen Habermas und auch Mohandas Gandhi. Nach allgemeiner Auffassung handelt es sich beim zivilen Ungehorsam um eine Protestform, die gezielt als ungerecht empfundene Verbote oder Gesetze missachtet, wobei auf Mittel der physischen Gewaltanwendung verzichtet wird. Dieser Gesetzesbruch wird von den Akteuren zudem moralisch begr ndet, wobei eine Bestrafung f r das entsprechende Vergehen akzeptiert wird.
