Climate Justice and Disaster Law

Climate Justice and Disaster Law

Climate disasters demand an integration of multilateral negotiations on climate change, disaster risk reduction, sustainable development, human rights and human security. Via detailed examination of recent law and policy initiatives from around the world, and making use of a capability approach, Rosemary Lyster develops a unique approach to human and non-human climate justice and its application to all stages of a disaster: prevention; response, recovery and rebuilding; and compensation and risk transfer. She comprehensively analyses the complexities of climate science and their interfaces with the law- and policy-making processes, and also provides an in-depth analysis of multilateral climate change negotiations under the 1992 United Nations Framework Convention on Climate Change.

Unsustainable practices worldwide in energy production and consumption have led to a plethora of environmental problems. Until recently environmental law largely overlooked the relevance of energy production and consumption; energy was seen to be of little significance to the advancement of sustainable development. This has changed since 2000 with the global concern attached to climate change, the publication by the United Nations of the World Energy Assessment and the detailed consideration given to this issue at the World Summit on Sustainable Development in Johannesburg in 2002. Australia has been seen to be lagging behind the other major industrialised nations of the world in addressing sustainable energy issues. This book was first published in 2006.
Multispecies Climate Justice, Disasters and Responsibility

Multispecies Climate Justice, Disasters and Responsibility

This innovative book provides a comprehensive articulation and analysis of the failure of existing climate, environmental and biodiversity regimes and laws to respond to the global polycrisis. Rosemary Lyster, Danielle Celermajer and Phillipa McCormack propose a radical relational transformation in the form of Multispecies Climate Justice, including procedural justice. Chapters systematically link responsibility for the destruction of Earth others to the rise of neoliberalism and the failure of dominant systems of law to address the problems at this structural level. The authors build on Indigenous knowledge, relational ontologies and evolutionary developmental biology to articulate a novel, critical methodology for explicitly recognising Earth others in statutory re-drafting and the reimagining of climate and biodiversity laws. They critique the dominant legal approaches, presenting Multispecies Climate Justice as an alternative metanarrative for law and a transformative way forward. Multispecies Climate Justice, Disasters and Responsibility is an essential resource for academics and students in law and development, climate and environmental law, human rights and climate change as well as politics and public policy. It is also an informative read for activists, practitioners, professionals and policymakers involved in climate justice.

Deforestation in tropical rainforest countries is one of the largest contributors to human-induced climate change. Deforestation, especially in the tropics, contributes around 20 per cent of annual global greenhouse gas emissions, and, in the case of Indonesia, amounts to 85 per cent of its annual emissions from human activities. This book provides a comprehensive assessment of the emerging legal and policy frameworks for managing forests as a key means to address climate change. The authors uniquely combine an assessment of the international rules for forestry governance with a detailed assessment of the legal and institutional context of Indonesia; one of the most globally important test case jurisdictions for the effective roll-out of ‘Reduced Emissions from Deforestation and Degradation’ (REDD). Using Indonesia as a key case study, the book explores challenges that heavily forested States face in resource management to address climate mitigation imperatives, such as providing safeguards for local communities and indigenous peoples. This book will be of great relevance to students, scholars and policymakers with an interest in international environmental law, climate change and environment and sustainability studies in general.

The revelatory, poignant story of Rosemary Kennedy, the eldest and eventually secreted-away Kennedy daughter, and how her life transformed her family, its women especially, and an entire nation."[Larson] succeeds in providing a well-rounded portrait of a woman who, until now, has never been viewed in full."—The Boston Globe “A biography that chronicles her life with fresh details . . . By making Rosemary the central character, [Larson] has produced a valuable account of a mental health tragedy and an influential family’s belated efforts to make amends.”—The New York Times Book Review Joe and Rose Kennedy’s strikingly beautiful daughter Rosemary was intellectually disabled, a secret fiercely guarded by her powerful and glamorous family. In Rosemary, Kate Clifford Larson uses newly uncovered sources to bring Rosemary Kennedy’s story to light. Young Rosemary comes alive as a sweet, lively girl adored by her siblings. But Larson also reveals the often desperate and duplicitous arrangements the Kennedys made to keep her away from home as she became increasingly difficult in her early twenties, culminating in Joe’s decision to have Rosemary lobotomized at age twenty-three and the family’s complicity in keeping the secret.Only years later did the Kennedy siblings begin to understand what had happened to Rosemary, which inspired them to direct government attention and resources to the plight of the developmentally and mentally disabled, transforming the lives of millions. Rosemary is Book 11 in the Widows of Wildcat Ridge Series. A devastating mine accident has claimed the life of Rosemary Brennan's husband, Jack, along with nearly all the men of Wildcat Ridge. The mine owner, Mortimer Crane, has given the widows an ultimatum-find husbands or he will evict them from their homes and businesses. Desperate to keep the assay office that Jack had managed, Rosemary heads into the hills in search of an old Spanish mine called The Floriana in the hope she can lay claim to a bonanza of gold. Ex-U.S. Deputy Marshal Miles McGinty arrives in Wildcat Ridge to pay his respects to Brennan's widow. He and Jack had a history, and Miles is heartsick over the loss of the young man he had come to think of as a brother. When he learns of Rosemary's problems with the piggish Crane, he will do anything to help her-even offering marriage. But when it becomes clear that Crane knew of Jack's criminal past and was blackmailing him over it, Miles must decide whether to tell Rosemary the truth, because doing so may drive her away. And to his surprise, Miles has fallen in love with his new wife. A sweet romance set in 1884 Utah Territory.
