Cyber Attacks and International Law on the Use of Force
Examining the thematic intersection of law, technology and violence, this book explores cyber attacks against states and current international law on the use of force. The theory of information ethics is used to critique the law’s conception of violence and to develop an informational approach as an alternative way to think about cyber attacks.Cyber attacks against states constitute a new form of violence in the information age, and international law on the use of force is limited in its capacity to regulate them. This book draws on Luciano Floridi’s theory of information ethics to critique the narrow conception of violence embodied in the law and to develop an alternative way to think about cyber attacks, violence, and the state. The author uses three case studies – the 2007 cyber attacks against Estonia, the Stuxnet incident involving Iran that was discovered in 2010, and the cyber attacks used as part of the Russian interference in the 2016 US presidential election – to demonstrate that an informational approach offers a means to reimagine the state as an entity and cyber attacks as a form of violence against it.This interdisciplinary approach will appeal to an international audience of scholars in international law, international relations, security studies, cyber security, and anyone interested in the issues surrounding emerging technologies.

This book takes stock of the development of EU criminal law from the establishment of the ECSC to the first European Union criminal law directives passed after the Lisbon Treaty. Mulids, festivals in honor of Muslim ""friends of God,"" have been part of Muslim religious and cultural life for close to a thousand years. While many Egyptians see mulids as an expression of joy and love for the Prophet Muhammad and his family, many others see them as opposed to Islam, a sign of a backward mentality, a piece of folklore at best. What is it about a mulid that makes it a threat to Islam and modernity in the eyes of some, and an indication of pious devotion in the eyes of others? What makes the celebration of a saint’s festival appear in such dramatically different contours? The Perils of Joy offers a rich investigation, both historical and ethnographic, of conflicting and transforming attitudes toward festivals in contemporary Egypt. Schielke argues that mulids are characterized by a utopian momentum of the extraordinary that troubles the grand schemes of order and perfection that have become hegemonic in Egypt since the twentieth century. Not an opposition between state and civil society, nor a division between Islamists and secularists, but rather the competition between different perceptions of what makes up a complete life forms the central line of conflict in the contestation of festive culture.

This book studies ideological divisions within Chinese legal academia and their relationship to arguments about the rule of law. The book describes argumentative strategies used by Chinese legal scholars to legitimize and subvert China's state-sanctioned ideology. It also examines Chinese efforts to invent new, alternative rule of law conceptions. In addition to this descriptive project, the book advances a more general argument about the rule of law phenomenon, insisting that many arguments about the rule of law are better understood in terms of their intended and actual effects rather than as analytic propositions or descriptive statements. To illustrate this argument, the book demonstrates that various paradoxical, contradictory and otherwise implausible arguments about the rule of law play an important role in Chinese debates about the rule of law. Paradoxical statements about the rule of law, in particular, can be useful for an ideological project.
