Architectural models are used at various stages of a project. As working models they support the design process: they are made up from time to time using simple materials, such as cardboard, without any attempt at accuracy, and continue to be adjusted and added to as the ideas and the design progress. Passivlegitimation Im Gewerblichen Rechtsschutz Und Urheberrecht
Die Passivlegitimation im Urheber-, Marken- und Wettbewerbsrecht unterliegt einer sich standig wandelnden Rechtsprechung. Insbesondere der Bundesgerichtshof versucht auf die mannigfaltigen Rechtsverletzungen durch die Nutzung des Internets zu reagieren. Hierdurch wurde eine Vielzahl von Zurechnungssystemen zur Bestimmung der Passivlegitimierten geschaffen. Auch in der Literatur zum gewerblichen Rechtsschutz und Urheberrecht konnten sich keine einheitlichen Kriterien zur Bestimmung des Anspruchsgegners des urheber-, marken- und wettbewerbsrechtlichen Unterlassungsanspruchs herausbilden. Diese Arbeit zeigt einen dogmatisch sauberen und fur die drei genannten Rechtsgebiete tauglichen Loesungsansatz uber die Einbindung der Verkehrspflichten in die untersuchten Rechtsgebiete. Die als Stoererhaftung bekannte Inanspruchnahme von lediglich mittelbar an einer Rechtsverletzung Teilnehmenden wird anhand der im Burgerlichen Recht entwickelten Verkehrspflichtdogmatik bestimmt. Die Verkehrspflichtverletzung ersetzt und konkretisiert die bisher von der Rechtsprechung angewandte Voraussetzung der Verletzung einer Prufungspflicht. Daruber hinaus schafft sie die Moeglichkeit, einen mittelbaren Verletzer fur die Begehung eigenen Unrechts haften zu lassen, und hierneben den Stoerer fur die Teilnahme an der Begehung fremden Unrechts.
