Immigration crises faced by the United States today show the interplay between areas of global law and policy that might at first glance seem quite disparate--economic law, human rights and refugee law, and criminal law relating to the trafficking and smuggling of migrants. This book is largely dedicated to unpacking those dynamics and ultimately argues that reform efforts must be expanded. Using as a central case study how international law relates to the irregular labor migration of undocumented migrant farm workers in upstate New York, this book examines the conditions for entry of these workers, for their residence and work while in the US, and finally what happens if they are apprehended and subject to expulsion. The author aims to show that the presence of these migrants can be significantly attributed to dynamics flowing from international economic law, and that the interaction of international economic law with international human rights, refugee, labor and criminal law in defining their legal rights and remedies is often incoherent. As such, this wave of irregular migration might be seen as the product of a "perfect storm" in international law: a vexed and unstable relationship between disparate regimes that propels dynamic population movements without just and orderly means of protection.

One morning in 1721, he decides to marry eleven-year-old Louis XV to the daughter of Philippe V of Spain, who is only four. Orl ans hopes this will tie his kingdom to Spain. But were Louis to die without begetting an heir--the likeliness of which is greatly increased by having a child bride--Orl ans himself would finally be king. Orl ans tosses his own daughter into the bargain, the twelve-year-old Mlle de Montpensier, who will marry the Prince of Asturias, the heir to the Spanish throne. The Spanish court enthusiastically agrees and arrangements are made. The two nations trade their princesses in a grand ceremony in 1722, making bonds that should end the historical conflict. Nothing turns out as expected.

These chapters address some of the most pressing issues facing these countries, while reflecting on Robert E. Hudec's groundbreaking book, Developing Countries in the GATT Legal System. In his landmark contribution, Hudec argued against preferential and non-reciprocal treatment for developing countries. He did so on the basis of a combination of economic, political and legal insights that persuasively demonstrated that non-reciprocal treatment would not benefit developing countries. It is a testament to Hudec's legacy that his analysis is still the object of scholarly discussion more than 20 years later. The first part of this book evaluates the general situation of developing countries within the WTO. The second part examines market access and competition law within these countries. Lastly, it discusses the special arrangements these countries have with international financial institutions, the developing country's capacity to litigate, and an analysis of the country's level of participation in WTO dispute settlements.
