De studie van de lijfstraffen en het bijzondere karakter van de machtsinstellingen kan niet in een hokje worden gestopt in een louter academische regeling of in een noodzaak die wordt opgelegd door economische, politieke of autoritaire argumenten. In dit academisch werk worden drie belangrijke aspecten van de studie van de bestraffing gepresenteerd: de historische ontwikkeling, de hervorming van het bestraffende element, het gebruik ervan en de effecten op het huidige normatieve en praktische paradigma. Daartoe wordt een kritische blik geworpen op de voorstellen die zijn onderworpen aan een studie van het fenomeen van de bestraffende gebeurtenissen, alsook op het strafrechtelijk systeem zelf en zijn regelgeving, waarbij wordt getracht meer dan alleen theorie, toetsing en analyse te systematiseren, een manier om fundamentele bijdragen te leveren die ook de fouten van een heel praktisch en reglementair systeem aan het licht brengen.

The study of the figure of corporal punishment and with it the particularity of the institutions of power, cannot be pigeonholed into a mere academic disposition or into a necessity imposed by arguments of an economic, political or authoritarian order. In this academic work three main aspects of the study of the punitive exercise are presented: historical development, the reform of the punitive element, its use and effects on the current normative and practical paradigm. To this end, a critical review is made of the proposals that have been subjected to a study of the phenomenon of punitive events, as well as of the criminal justice system itself and its regulations, seeking to systematize more than just theory, review and analysis, a way of providing fundamental contributions that also reveal the mistakes of an entire practical and regulatory system.

Die Untersuchung der Figur der K rperstrafe und damit der Besonderheit der Machtinstitutionen l sst sich nicht in eine rein akademische Disposition oder in eine durch Argumente einer wirtschaftlichen, politischen oder autorit ren Ordnung auferlegte Notwendigkeit einordnen. In dieser wissenschaftlichen Arbeit werden drei Hauptaspekte der Untersuchung der Strafaus bung vorgestellt: die historische Entwicklung, die Reform des Strafelements, seine Verwendung und die Auswirkungen auf das gegenw rtige normative und praktische Paradigma. Das Papier gibt eine kritische bersicht ber die Vorschl ge, die einer Untersuchung des Ph nomens der Strafverfolgung sowie des Strafrechtssystems und seiner Vorschriften unterzogen wurden, und versucht, diese zu systematisieren, anstatt sie zu theoretisieren, zu berpr fen und zu analysieren. Auf diese Weise werden grundlegende Beitr ge geliefert, die auch die Fehler eines ganzen praktischen und ordnungspolitischen Systems aufzeigen.

Dans ce travail acad mique, trois aspects principaux de l' tude de l'exercice punitif sont pr sent s: le d veloppement historique, la r forme de l' l ment punitif, son utilisation et ses effets sur le paradigme normatif et pratique actuel. cette fin, les propositions qui ont fait l'objet d'une tude du ph nom ne des faits punitifs, ainsi que du syst me de justice p nale lui-m me et de sa r glementation, font l'objet d'un examen critique qui cherche syst matiser plus que la th orie, la r vision et l'analyse, une mani re d'apporter des contributions fondamentales qui r v lent galement les erreurs de tout un syst me pratique et r glementaire.

Lo studio delle punizioni corporali e la particolarit delle istituzioni del potere non pu essere imprigionato in un mero accordo accademico o in una necessit imposta da argomentazioni economiche, politiche o autoritarie. In questo lavoro accademico vengono presentati tre aspetti principali dello studio dell'esercizio punitivo: lo sviluppo storico, la riforma dell'elemento punitivo, il suo uso e i suoi effetti sul paradigma normativo e pratico attuale. A tal fine, si procede a una revisione critica delle proposte che sono state oggetto di studio del fenomeno degli eventi punitivi, nonch del sistema giudiziario penale stesso e della sua regolamentazione, cercando di sistematizzare pi che la teoria, la revisione e l'analisi, un modo per fornire contributi fondamentali che rivelino anche gli errori di un intero sistema pratico e normativo.
