Die Arbeit behandelt die prozessualen Schranken der Formfreiheit im internationalen Vertrags- und Prozessrecht. Folge solcher prozessualen Schranken ist, dass Formfreiheit haufig verfahrensrechtlich durchbrochen wird: Ein Vertrag, der den Formvorschriften nicht nachkommt, ist nicht unwirksam, sondern wird vielmehr auf prozessrechtliche Probleme der Durchsetzbarkeit stossen. Ein typisches Beispiel stellt Art. 1341 des franzoesischen Code civil dar, der als Beispielsnorm im Mittelpunkt der Arbeit steht. Vergleichbare Normen findet man im angelsachsischen und italienischen Rechtskreis. Solche Vorschriften haben uberdies eine doppelte Wirkungsweise, da sie auf die Zulassigkeit sowohl der Beweismittel als auch der Gegenbeweise ausstrahlen. Die Frage der Qualifikation der prozessualen Schranke von Formvorschriften, welche als ein Musterbeispiel fur die Durchbrechung des starren Prinzips der lex fori gilt, beruhrt auch die dogmatischen Fundamente der Qualifikationsmethode selbst.
