The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 provided new requirements for bankruptcy filers and gave the U.S. Trustee Program (USTP) new responsibility. Individual filers must now receive credit counseling during the 180 days before filing. USTP is charged with approving and reapproving counseling providers. This report examines steps USTP can take to develop measures of effectiveness of prebankruptcy credit counseling.
Identifying Fraud, Abuse, and Error in Personal Bankruptcy Filings
The U.S. Trustee Program (USTP), part of the U.S. Department of Justice, identifies and measures fraud, abuse, and error in personal bankruptcy filings. USTP asked the RAND Corporation to assist it in thinking about how to do this better. The authors conclude that a data-enabled case filing system, incorporating lessons from the IRS and GSA as well as the private sector, may be the direction for the future of the bankruptcy court system.

The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA) limited the types and quantities of exempt household goods on which debtors could avoid certain liens. Part of the motivation for these changes was a perception that debtors were using household goods as collateral to obtain loans that they never intended to repay. This study found no changes in debtor or creditor behavior due to the new definition of household goods.

Identifies and assesses obstacles to disposing of excess Army lands that contain unexploded ordnance, and identifies innovative options for the disposal of these lands; In the ongoing Base Realignment and Closure (BRAC) process, lands containing unexploded ordnance (UXO) left over from military training have proved particularly difficult and costly to transfer to new users. With a few exceptions, little progress has been made in transferring these lands. This monograph chronicles both the issues that facilitated the transfer of UXO-contaminated lands and those that slowed the transfer, and it offers options for expediting the transfer of these lands.
