Somit kommt dem Ausweisdokument, als Beleg f r Staatsb rgerschaft, die weitere Funktion der Bennenung von Rechten zu, oder anders formuliert das "Recht, Rechte zu haben." Die Bestimmung hier ber, wer Rechte genie en darf und wer nicht, geht meist mit der auf Verfassungen projezierten Hoffnung auf eine gute und gerechte Ordnung Schritt und h lt diese in Schach. Die Geltung einer neuen Verfasstheit verweist somit auf eine Ambivalenz zwischen faktischer Geltung bergeordneter Rechtsnormen und deren exklusivem Charakter - die Verfassung eines Nationalstaats gilt nicht global, sondern national; auch wenn allgemeine Prinzipien mit universellem Rang formuliert werden. Nachdem die radikal-islamistische Partei Hamas den zwischen ihr und Israel seit Juni 2008 bestehenden Waffenstillstand gebrochen hatte und den j dischen Staat mit ca 300 selbstgebauten Qassam-Raketen beschossen hatte1, beschloss das israelische Parlament, die Knesset, eine Bodenoffensive zur Bek mpfung der Hamas. Nach 21 Tagen heftiger K mpfe und einer hohen Zahl an Opfern verk ndete Ehud Olmert, israelischer Ministerpr sident, eine einseitige Waffenruhe. Nachdem die Hamas am darauffolgenden Tag ebenfalls eine Waffenruhe verk ndigte, zogen sich die israelischen Truppen hinter die Grenzen zur ck, blieben aber in Alarmbereitschaft. Resultat dieser kurzen Offensive sind ca 13 Tote und 84 Verletzte auf israelischer, ca. 1.330 Tote und 5.450 Verletzte auf pal stinensischer Seite2, ein Konflikt, dessen Aussicht auf L sung entfernter denn je scheint und zwei verh rtete Fronten, die einen Dialog mit dem jeweiligen Gegner ablehnen. Die Kontrahenten in diesem Krieg, Israel als parlamentarische Republik und die radikal-islamische Hamas als st rkste Kraft im Gaza-Streifen als Teil der pal stinensischen Autonomiegebiete sind in diesem Konflikt keine neuen Gegner, sondern Teil der Fortsetzung eines lang andauernden Kampfes. Die Forderungen Israels beschr nken sich im wesentlichen auf die Beibehaltung des Status Quo, w hrend sich die Forderungen der Hamas auf die "Zerst rung Israels und die Schaffung eines islamischen Staates in Pal stina" beziehen3. Somit kann die R son des Staates Israel als eine sicherheitspolitische, die der Hamas als eine militant-agressive Beschrieben werden
