In Deutschland ist die Diskussion über die große Schuldrechtsreform in vollem Gang.Peter Huber arbeitet die Grundlagen des Konkurrenzverhältnisses beider Rechtsinstitute heraus und wendet sie anschließend auf die deutsche lex lata und die neuen Regelwerke, einschließlich des Kommissionsentwurfs zur Schuldrechtsreform, an.
