Royal Law

Royal Law

This book argues that prerogative powers encompass all the non-statutory powers of the Crown. Hence the Crown has no 'third source' powers, common law powers or 'Ram doctrine' style freedoms. Royal Law builds on Dicey's definition of the prerogative, arguing that it comprises all residual non-statutory rights, powers, duties, and immunities historically ascribed to the Crown. However, it contends that Blackstone’s alternative definition, that prerogative powers are only those powers exclusive to the Crown, is also correct. The book explains how Dicey and Blackstone can be reconciled. The prerogative of justice is suggested as the original source of legal authority and legitimacy of common law judicial decisions. Common law is, or was, royal law. Defined as a putative non-statutory, non-prerogative third source of judicial legitimacy, authority or jurisdiction, 'common law' does not exist. There are only two ultimate sources of jurisdictional authority: statute and prerogative. The book further argues that Wade was mistaken to contend that the Crown has 'common law powers'. It also has no 'third source freedoms', as suggested by Harris, or in the 'Ram Doctrine’. The book therefore reframes the relevant case law as examples of judicial regulation of prerogative powers, crucially including the largely-forgotten prerogative power to administer the realm. Hence the book concludes that legal powers such as a minister's power to enter contracts or make ex gratia payments of public money, are directly or indirectly grounded in prerogative power.

'If you're satisfied with yourself, beware of D blin.' It was with this temptation for brave souls that G nter Grass closed his tribute on the tenth anniversary of the great modernist's death. Alfred D blin is best known for his city masterpiece of 1929, Berlin Alexanderplatz. But the journey to the 'Alex' takes us along pathways both less familiar and every bit as intriguing. In the decades before his flight into exile in 1933, this medical doctor-cum-writer broke new ground both as an Expressionist storyteller and an author of experimental historical and science fiction. Not only that, but he made radical contributions to poetics, aesthetics and nature philosophy. The focus of this innovative study, one of the first of its kind in English, is a thorny and intractable relationship that perennially fascinated D blin: that of nature and the self. Robert Craig shows how his eclectic works before 1933 traced out an evolving dialectic between the human and the natural, and between the subject and its forms and modes of embodiment. The constellations that emerged remain as illuminating as they are unsettling and discomfiting.Robert Craig teaches German and English literary and cultural studies at the Otto-Friedrich-Universit t in Bamberg.

The architectural development of Georgia Tech began as a core of Victorian-era buildings sited around a campus green and Tech Tower. During the subsequent Beaux-Arts era, designers (who were also members of the architecture faculty) added traditionally styled buildings, with many of them in a pseudo-Jacobean collegiate redbrick style. Early Modernist Paul Heffernan led an architectural revolution in his academic village of functionalist buildings on campus--an aesthetic that inspired additional International Style campus buildings. Formalist, Brutalist, and Post-Modern architecture followed, and when Georgia Tech was selected as the Olympic Village for the 1996 Summer Olympics, new residence halls were added to the campus. Between 1994 and 2008, Georgia Tech president G. Wayne Clough stewarded over $1 billion in capital improvements at the school, notably engaging midtown Atlanta with the development of Technology Square. The landscape design by recent campus planners is especially noteworthy, featuring a purposeful designation of open spaces, accommodations for pedestrian perambulations, and public art. What might have developed into a prosaic assemblage of academic and research buildings has instead evolved into a remarkably competent assemblage of aesthetically pleasing architecture.
