In the quest for human rights justice for communities and workers whose rights are breached by transnational businesses, non-judicial mechanisms (NJMs) are often deployed, but how effective are they? This book creates a blueprint for reforming transnational human rights NJMs and for helping communities and workers to use them. Through 587 interviews with 1100 individuals over five years of research in Indonesia and India, the authors delve into the practical workings of NJMs in diverse industries and contexts. The findings reveal that while NJMs are limited in providing standalone remedies, they can play a valuable role within a broader regulatory ecosystem. Combining rich empirical data, multi-method analyses and a new theoretical framework, the authors argue for a multi-pronged approach to human rights redress. Their findings will advance both academic and policy debates about the merits and shortcomings of NJMs.

This book is driven by a quest to re-regulate work to reduce informality and inequality, and promote a living wage for more people across the world. It presents the findings of a multidisciplinary study in four countries of varying wealth and development, exploring why people become trapped in precarious work. The accounts describe the impact of supply chain governance, trade agreements, internal and between-country migration, legal factors, as well as the socio-economic characteristics and outlooks of the workers. In a unique approach, the chapters describe existing labour regulation measures that have succeeded, but which have to date attracted little scholarly attention. Building on these existing innovations, the book proposes a new international labour law which would incrementally increase the wages of the poor and regulate precarious work in global supply chains.

The book draws from the literature concerning 'Varieties of Capitalism' (VoC) and the different institutional and regulatory designs inherent in different types of political economy. The book is informed by a new and extensive set of empirical data from Australia that examines the activities of national and multinational business corporations, their outlooks and relationships with stakeholders, and relates these to new and evolving theoretical frameworks based in political economy and law. The book places the Australian regulatory model within this international debate, and assesses the extent to which the system does or does not fit into the general categorisation created in the VoC literature.
