English summary: Criticism of the welfare state is common among modern societies who are trying to hold their own in global competition, and it can be said that, at first sight, social rights do not fit in with the economic concerns of modern democracies. In this work, Thilo Marauhn develops a concept of social rights as fundamental rights based on citizenship. Social citizenship means individual rights and responsibilities and thus is in sharp contrast to paternalistic welfare state models. Based upon the pragmatic case law of the German Federal Constitutional Court in respect to state policy objectives and human rights guaranteed under the Basic Law, Marauhn reinterprets social rights as individual procedural rights. Soziale Grundrechte sind bei entsprechender Konstruktion operabel und justiziabel, ohne die Budgetverantwortung des Parlaments zu unterminieren.

Art. 3 Abs. 1 des "Zwei-plus-Vier"-Vertrages schreibt den Verzicht des vereinten Deutschlands auf Herstellung und Besitz von sowie auf Verfugungsgewalt uber atomare, biologische und chemische Waffen unter Bezugnahme auf vorhandene Rechtsinstrumente fest. Ausgehend von dieser Norm beschaftigt sich die vorliegende Untersuchung mit der Entwicklung der Rechtsgrundlagen des deutschen Chemiewaffen-Verzichts unter besonderer Berucksichtigung ihres historisch-politischen Umfelds. Die volkerrechtlich relevante Praxis der beiden deutschen Staaten bis 1990 und des vereinten Deutschlands seit 1990 wird dargestellt und bewertet. Die einschlagigen Bestimmungen werden schliesslich zu den materiellen Verbotsnormen der 1993 gezeichneten Chemiewaffen-Konvention in Beziehung gesetzt.
